Terms and Conditions
By signing up for our service, you (“you,” “your,” or “renter”) are entering a legal agreement with Vestido (“Vestido,” “we,” “us,” or “our”) for the rental of our products. As the renter, you will submit information, rent dresses and accessories (“product,” “products,” “item,” “items,” “rental” or “rentals”), and receive related “services” from Vestido through our website, www.vestidomanila.com (the “website”).
BY CLICKING ON THE “I ACCEPT” BUTTON OR ORDERING THE PRODUCTS, YOU ARE AGREEING TO BE BOUND BY AND ARE BECOMING A PARTY TO THIS AGREEMENT. IF YOU DO NOT AGREE TO ALL OF THE TERMS OF THIS AGREEMENT, CLICK THE “I DO NOT ACCEPT” BUTTON AND YOU WILL NOT BE PERMITTED TO RENT AND/OR PURCHASE THE PRODUCTS. WE RESERVE THE RIGHT TO CHANGE THE TERMS OF THIS AGREEMENT IN THE FUTURE AND ANY CHANGES WILL APPLY TO THE RENTAL/PURCHASE OF ANY PRODUCTS AFTER THE DATE OF SUCH CHANGE.
Rental Agreement
You agree that your general use of our website, other than rental orders as set forth in this Agreement, is subject in all respects to our website’s terms and conditions of use. As such, these terms may change from time to time. No other terms or conditions (preprinted or otherwise) shall have any force or effect. You agree and acknowledge that you are renting the products and that ownership of the products remains with Vestido at all times. Our products may be rented for use by individuals under 18 years of age, but we rent only to adults who must pay with a credit card or other approved payment method. If you are under 18 years of age, you may accept these terms and conditions and order products only with the involvement and approval of your parent or legal guardian.
The rental period immediately begins when the product/s have been delivered to your address, regardless of who receives it. This ends when the rentals have been returned in an acceptable condition as inspected by us. You are responsible for the products while they are in your possession and as such, you are expected to take good care of the rentals as if they are your own. This includes inspecting for damages upon receipt and reporting them to Vestido immediately prior to use. Renter will be held liable for failing to report damages.
In the event that the rentals are damaged, we will assess the product and inform you of the additional charges needed to repair the piece. Should the rental be lost or damaged beyond repair, you will be required to make payment equivalent to its full present value as specified on Vestido's Consignor Agreement. Always return the product if it is not lost, regardless of the condition it is in. This way, we will be able to determine if the rental can be repaired at a lower cost versus the full present value. Please note that you are liable for the repairs and replacement, and the agreed upon present value between Vestido and its Consignors will be charged to you.
Vestido shall not be liable for failure to perform any of its obligations hereunder by reasons that are beyond its reasonable control, including (without limitation) fire, earthquake, interruptions in supply, other natural disasters, war embargo, and/or riots or acts of terrorism.
Rental Fee, Late Fee, and Cancellation
Upon renting a product, you hereby authorize us to charge your credit card for the “rental fee” which will be charged immediately. A reservation of a product on our website is an order for the rental of that product, regardless of how far in advance that product is reserved. In addition, at the time of your order of a product, you hereby authorize Vestido to charge your credit card for the full present value of the product set forth on Vestido's Consignor Agreement; provided that we will only charge the present value in the circumstances set forth above in case of damage or loss. You may cancel your order for products, but note that the full amount of credits will only be refunded if the cancellation is made 3 days before the stipulated rental period. If it is made 48 hours prior to delivery date, we will refund 50% of the fee, or 20% if it is done within 24 hours. Credits will be valid up to 6 months from date of issue.
If the product/s are held beyond the agreed Period of Rent without our consent, we will charge you P1,000 per day in addition to damages, such as loss of client/business caused by this action.
If the renter cannot be contacted or is unavailable during the agreed delivery/pickup times, leading to a failed delivery/pickup of the rental, you will be charged accordingly for additional arrangements to deliver/pickup the item.
If there are any changes to delivery and/or return address, and/or methods, and/or dates, and/or timings, Vestido must be notified at least 24 hours before the original delivery and/or return date. For Monday deliveries/pickups, renter has to inform Vestido of any changes by Friday 6PM. If we are not informed before the cut-off time, the charges for last-minute changes will be P1,000—the same per day rate as a late return.
Delivery
We will deliver the products you ordered, including the specified size, color, and design, on or before the date for which you ordered them, except to the extent we informed you in connection with your order that the specific product is not guaranteed. Products may appear different in color and style than the photos displayed on our website. Our liability to you for failure to deliver the product as ordered is limited to the timely delivery of product as ordered or a refund of the rental fee (excluding insurance and delivery charges) as determined by us.
Laundry
The products will be professionally cleaned and delivered ready to wear. We dry clean and inspect each product with the utmost care, but use of the product is at your own risk. Vestido shall not be held liable for any health-related complaints associated with a product rented from our site.
Services
We offer various Services on our website to assist you in selecting a product. Our services are provided “AS IS” without guarantee to its results.
Receipt of Products
Upon delivery, you will bear responsibility for the product/s at the location specified at time of check out. You acknowledge that a secure shipping address is highly recommended. A secure shipping address is defined as a location where an individual can physically receive product/s. In the event that an unsecure shipping address is provided, Vestido does not bear liability for products left unattended. Furthermore, you acknowledge that providing anything other than a secure shipping address may result in delivery delays and additional delivery fees for which Vestido is not to be held liable, but you will be held liable.
Use of Products
You agree to treat the products with great care, as if it was borrowed from one of your close friends. You are responsible for loss, destruction, or damage to the products due to theft, mysterious disappearance, fire, major stains, and any other causes other than normal wear and tear. Normal wear and tear encompasses minor stains, rips, missing beads, stuck zippers, or other minor damage covered by the insurance you paid for with your rental of the applicable product. If you return a product that is damaged beyond normal wear and tear, you will agree and pay for charges including the price for repairing or replacing the product, as determined by our discretion, up to the present value of the product.
You will also assume sole and exclusive responsibility and liability for any claims against you and/or damages arising from use of the products during your rental period.
Return of Products and Extension Requests
You agree to return the products to Vestido in its original garment bag or dust bag on the date set forth on the website in connection with your rental. You may extend your rental by writing us an email at hello@vestidomanila.com, provided that there are no pending rentals for the product. If you return the product/s late or not at all, a late fee of P1,000 will be charged to you every day that you are late, on top of the initial rental fee already charged and other losses Vestido will incur because of this. Failure to return the product/s in its original bags will be subject to additional charges made to your account to cover its cost.
Return of Unworn Rentals Due to Size
If your rental does not fit, you may return the product to us within 24 hours (excluding Sundays and holidays) of the date you received the rental by contacting us via email or phone and returning the product in its original garment bag or dust bag. We will then issue you a credit for the full rental fee (less delivery charges) of the product to use for your personal future rental—so long as the product, based on our sole discretion, has not been worn.
Collections
If you do not pay the amount owed to us when due, then we will need to institute collection procedures. You agree to pay our costs of collection, including (without limitation) reasonable attorneys’ fees.
Refusal of Service
We reserve the right to terminate your rental of products from us at any time in the event of your breach of this agreement, or for unspecified reasons, or any other reason based on our discretion.
We will use the preferences and orders you provide on our website to send you emails and other marketing materials for other products. You may opt out of receiving those emails by contacting us or following the links provided at the bottom of those emails when available.
